Rockface Disclaimer and Conditions of Entry Disclaimer
Age Requirement 18+
I am, or my legal guardian is, aged 18 years or over and can be deemed legally competent to sign this agreement.
Inherent Risks of Rock Climbing
I understand and acknowledge that:
1. indoor rock climbing involves risks which may cause various injuries that may result in death or serious disability.
2. indoor climbing is physically demanding and in susceptible people may cause panic, hyperventilation or heart attack.
3. The risk of injury may arise due to equipment failure, falling objects, human error, and any combination thereof.
4. Rockface has no qualified medical assistance available and I accept the risk that in the event of injury requiring medical treatment, I will have to obtain such assistance from an independent source
Notwithstanding points 1 – 4 above (inclusive) I wish to participate and voluntarily assume the risk of injury or bodily harm to myself.
Release and Indemnity from Compensation
I hereby release and indemnify Rockface and subsidiaries and associated bodies as defined under the Corporations Law (Cth) Rockface its servants and agents, the owner of the premises and any other persons involved in my participation in indoor climbing at Rockface from all actions or claims for compensation arising from my participation for personal injury and/or death or damage to property.
Ongoing Validity of Waiver
I agree this waiver is ongoing and will apply to all future occasions I participate in indoor climbing at Rockface.
Contractual Document
I acknowledge that this document is contractual and may be relied upon any proceedings by me, my heirs, executors and assigns, and this waiver release and indemnity is given in consideration of Rockface permitting me to participate in indoor climbing at Rockface.
Compliance with Rules/Conditions of Entry
I have read the Rockface Conditions of Entry (below) and I agree to comply with the Conditions of Entry at all times whilst at Rockface.
Compliance with Instructions
I agree to comply with all instructions given to me by Rockface relating to my participation in indoor climbing. I agree to indemnify Rockface, its servants and agents and the owner of the premises against all liability that may incur, including legal costs, caused by my negligence or failure to comply with such instructions.
I will not conduct activities within Rockface for which I am not certified.
Medical Conditions
I warrant that I do not suffer from any medical condition that may affect my ability to participate safely in strenuous exercise, including rock climbing.
Where climber is under 18
The legal guardian of any person under the age of 18 years agrees and acknowledges that the matters referred to in items 1-4 under the heading ‘Inherent Risks of Rock Climbing’ apply to any person under the age of 18 years.
Image Release
We’re proud of our venues and those who choose to take part in climbing. To promote the sport and Rockface, we publish visual media taken at our venues in various media formats, including online and on social media. Recordings do not aim to capture individual members. However, you may be visible and identifiable in the background. I consent to Rockface using images in which I appear for promotional purposes. I waive any rights and claims to any benefits in connection with the use of the images.
Conditions of Entry
• No person is permitted to do anything which will injure or increase the likelihood of injury to themselves or anyone else in this facility.
• Patrons must follow all safety instructions from Rockface staff, regardless of whether they are included in the written rules.
• All climbers and belayers must complete a Rockface gym disclaimer.
• New customers must be inducted by a Rockface staff member before they begin climbing or belaying. Patrons must not instruct or accept instruction from anyone other than Rockface staff.
• Climbers using their own equipment must ensure it is suitable for the intended purpose and in a safe condition.
• Patrons must wear enclosed shoes when climbing, and should remove all jewellery.
• Pay attention to signs and barriers. These are for your own safety.
Children
• Children less than 12 years of age must be supervised by a parent or guardian at all times.
In bouldering areas, no more than two (2) children per supervising adult.
• Belayers must be at least 12 years old.
Bouldering
• Climbers must not boulder above the second panel on the top-rope walls. Beware of climbers being lowered from above.
• A spotter must be used for all hazardous moves.
• Children should not use the bouldering wall without adult supervision.
• Any person not climbing must remain off the mats.
• Harnesses must be removed before bouldering.
Lead Climbing
• Climbers must be approved by a Rockface staff member to lead climb. Rockface staff will provide you with a Lead Pass once you have successfully passed an assessment.
• No one is permitted to enter the lead area without a lead pass.
• Patrons are not permitted to teach one another lead climbing.
• Lead-specific rules are given as part of the lead test. Please see a staff member if you need a copy of those rules.
I HAVE READ, AND UNDERSTAND, THE TERMS OF THIS DOCUMENT. IN RETURN FOR BEING ABLE TO USE THE GYM, I AGREE TO BE BOUND BY ALL TERMS OF THIS DOCUMENT.
